Terms and Conditions for Offshore Adventures International Trips/Charters

Please read the following policies to ensure you understand that Offshore Adventures wants to provide you with the best possible fishing experience.
Offshore Adventures head office is located at 18 Devon Street, Mangawhai Heads, 0505, New Zealand.

Agreement
This document constitutes an agreement between Offshore Adventures (“Offshore Adventures” or “the company”) and you (“the client”, “the clients” or “you”).

Bookings, Deposits and Payments
All reservations must be made by email and include the date to which the reservation refers, the number of passengers, all passengers names and any special requirements.
The prices for our Offshore International Adventures are priced in USD. The deposit is in NZD and the final payment will be invoiced at the USD/NZD rate minus the deposit paid.
We accept Visa and MasterCard and use Payment Express as our secure payment provider.
Our Payment page is hosted by DPS and Offshore Adventures will not store your credit card details they are retained by our secure payment provider Payment Express.
Payments made by credit card will be charged a fee of 3%

Privacy of your personal information
Offshore Adventures may need to use your personal information provided such as name, address and passport details. This information may need to be provided to security or customs and immigration if required by them by law.
We will not pass your information to any person or organisation not involved in your travel arrangements. We will try our best to keep any personal information secure but we are not liable or responsible if any information enters the public domain.

Deposits
A 50% deposit of the total cost of the trip will be required to confirm the booking. This must be paid within 7 days of making the booking.
Up to 30 days from booking date deposit is 100% refundable less bank fees if applicable
After 30 days from booking date deposit is non refundable. We recommend you take out travel insurance to cover any loss due to unforseen circumstances that will cause you to cancel the booking.

Confirmation
As soon as the deposit has been received with the signed copy of the terms and conditions, Offshore Adventures will send you a confirmation of the booking in the form of an email as a receipt.

Balance of payment
Balance of payment must be made at least 60 days prior to the trip date. Offshore Adventures will send out a reminder invoice 30 days before final payment is due.
Payment method is to be made by bank transfer, visa or mastercard.  You must reference your invoice number.
All payments made by visa or mastercard will be charged a fee of 3%

Alterations to reservations
If you wish to cancel the booking this must be done in writing by email and cancellation fees may apply

Amendments
Amendments made by Offshore Adventures
Offshore Adventures reserves the right to change the details of a trip/charter without notice. In an event that changes have to be made to a trip this will be communicated to the clients as soon as possible via any form of communication.

Amendments made by the client
Any amendments made to the booking by the client maybe subject to amendment fees. The client should notify Offshore Adventures as soon as possible of any changes as the sooner this is done the more likely it is that we can make the changes.
Any changes will need to be made in writing via email to notify Offshore Adventures prior to the trip and depending on the availability and logistics an amendment fee may apply.
Due to the nature of Offshore Adventures fully guided group trips/charters it may be difficult/costly to change dates by one client’s request.
If we are unable to amend the clients’ arrangements due to circumstances beyond our control and the client wishes to cancel the booking normal cancellations fee will apply.
Clients should be aware that no refund is available if the client amends their arrangements during a trip.

Cancellation and Refunds
Cancellation by the client:
Any cancellation must be made in writing.
Offshore Adventures reserves the right to keep any payment in compensation for potential bookings lost and income.
Offshore Adventures reserves the right to resell a trip at a discounted rate if a fully funded booking is cancelled.
Less than 30 days from booking date 100% of the trip will be refunded less bank fees.
More than 30 days from booking date any payments received will be non-refundable.

Trip cancelled due to weather
On the rare occasion that Offshore Adventures cancels a trip due to weather or sea state, this will be done as soon as possible and will be confirmed to you.
Offshore Adventures will offer a 50% refund in the way of a credit for that days fishing lost. No full refund will be supplied. Offshore Adventures has made all the preparations for the trip and incurred costs and weather is out of their control.
Offshore Adventures recommends taking out travel insurance to cover any lost costs and will provide a quote for the value of the lost charter on request.

Trip Cancelled due to boat or engine failure
If a trip/charter is cancelled due to a broken engine or boat, Offshore Adventures will endeavour to provide a reasonable replacement. If a suitable replacement is not found or provided then Offshore Adventures will refund in the way of a credit 100% of the value of that day’s charter.

Trip cancelled by Offshore Adventures
Offshore Adventures has the right to cancel a trip/charter up to 24hrs prior to commencement of the trip/charter for any reason we deem necessary or beyond our control, including weather, sea state etc. In the event of a trip/charter cancellation alternative arrangements will be recommended if possible.
Offshore Adventures reserves the right to cancel a trip/charter for unavoidable situations such as natural disasters, epidemics etc. In the event of this happening Offshore Adventures will advise the client at their earliest convenience possible.
If Commencement of a fishing charter is not advisable or may be dangerous to the life or health of the client or Offshore Adventures staff or to the boat, Offshore Adventures has the sole discretion to delay or cancel the trip/charter.
Likewise during a fishing trip/charter if bad weather or a force of events occurs that make it inadvisable to continue with the charter Offshore Adventures has the sole discretion to delay or postpone seafaring until conditions allow.

Trip cancellation by Offshore Adventures for other reasons:
Offshore Adventures reserves the right to cancel a trip for other reasons that are unavoidable
and will inform the client the at the earliest possible date.

Cancellation for reasons caused by the client:
Offshore Adventures reserves the right to cancel a booking or services if actions on the client’s part give justifiable cause to do so. In such instance Offshore Adventures will not refund any payments already made. Further claims against Offshore Adventures will not be entertained.

Unused Services:
No refund will be considered for non-acceptance of pre-booked services once trip/charter has commenced irrespective of the reason. Where a client is unable to travel due to invalid or mislaid travel documents (e.g. passport, visas), the unused portion of service, which is included in the client’s package is not refundable. Any complaint while on a trip/charter should be made immediately to the Offshore Adventures guide. Please refer to the complaints section.

Trip Interruption:
If the client interrupts or calls short a trip/charter then Offshore Adventures is not liable to any refunds.

Passport and Visa
The client will be responsible to obtain the required visas, passports and travel documents and to ensure that all these documents are valid for the countries they are visiting. Offshore Adventures is not liable or responsible for any clients travel documents or visas.
Failure to have the correct travel documents, flights or visas resulting in the need to cancel travel arrangements will incur normal cancellation penalties. No refund will be available from Offshore Adventures due to lost travel documents or the failure to receive the correct travel documents.
If Offshore Adventures or your carrier is fined as a result of a client holding incorrect documents, it will be the client’s responsibility to pay this amount.

Insurance
Insurance 
Cancellation and refund conditions are strictly enforced. Offshore Adventures requires that you carry comprehensive travel insurance which covers all eventualities including medical care, cancellation or interruption due to unforeseen circumstances or other circumstances beyond the client’s control.
It is the client’s responsibility to obtain all travel, medical and goods insurance. Offshore Adventures will not be liable for any loss or damage to goods; or for medical care (including repatriation or transport to a care facility or to your home country) or for accidents on any Offshore Adventures trips, charters or services offered.
Offshore Adventures may offer to help the clients in the event of insurance claims.
We recommend that the client take out travel insurance within the 30 days of making the booking to provide cover for any unforeseen circumstances that may occur resulting in the client cancelling the booking.

Liability Release and Assumption of Risk:
Liability
Neither Offshore Adventures nor any person acting for, through or on behalf of the company shall be liable for any loss or damage. This includes damage arising from any cause, whether because of negligence or not. Examples of loss or damage include, but are not limited to:
loss or damage arising from any errors or omissions contained in its brochures or other literature;
late or non-confirmation or acceptance of bookings; and,
loss or damage caused by delays or illness, injury or death.
Offshore Adventures shall have the right to cancel the whole or part of any trip, charter or service. This may be done at any time, at Offshore Adventures’ discretion.
Offshore Adventures make any alteration in location, accommodation, price or other details any time, at its discretion.
If any trip is rendered impossible, illegal or inadvisable by weather, sea state, government or interference or any other cause, any extra expenses incurred as a result shall be your responsibility.
You warrant that in making any booking with Offshore Adventures, you have authority to enter into a contract on behalf of any person included in the booking. In the event that any or all of the other persons included in any booking fail to pay the required fees to Offshore Adventures, you assume personal liability for the total price of all bookings.

Delays
Offshore Adventures cannot be held liable for any delays owing to airlines, transportation, transfers not running on schedule or other such delays outside of Offshore Adventures’ control.

Indemnity
When you book any service with Offshore Adventures, you accept responsibility for any damage to property or accommodation caused by you or by any member of your party. You agree to indemnify Offshore Adventures against any claims (including legal costs) made against Offshore Adventures, or on behalf of the owner of any such property or accommodation.
You agree that Offshore Adventures cannot be held liable for and will not be responsible for personal injuries, property damage, or wrongful death that may occur during activities, as a result of the inherent risks associated with fishing and travelling to remote areas; or as a result of acts or omissions of yourself or other third parties.

Responsibility
Offshore Adventures does not accept any responsibility for any direct or indirect loss or injury to persons whether by negligence or otherwise on the part of the principal providing any facilities or services described on the website, brochures or other literature.
All receipts, itineraries and vouchers are issued subject to the terms and conditions. Offshore Adventures is not liable for any loss suffered by any person or any additional expense caused or occasioned by delay, change of aircraft service, alteration to any other travel service, illness, injury, civil disturbance, terrorism, quarantine, flood or other disturbances of any nature, which interferes, alters or adds to the cost of the service requested or booked.
Offshore Adventures is not liable for any dissatisfaction you may have with the properties. The above exclusions are subject to any statutory liability which, if unresolved may not be excluded by law. No employee of Offshore Adventures or its representatives can change the terms under which any person agrees to take the trips.

Damages resulting from personal injury, illness or death:
Offshore Adventures assumes no liability due to any cause, whether caused by failure or delay or other irregularity, acts or omissions occurring during a trip under which the means of transportation or other service provided thereby is offered or supplied by owners, operators or public carriers for and on behalf of Offshore Adventures. Damages resulting from illness, personal injuries or death which may be sustained by reason of, or while engaged on, any trip whether due to the ownership, maintenance, use, operation or control of any automobile, boat, vehicle, hotel, common carrier or any other conveyance used in carrying out these trips.
Offshore Adventures shall not be responsible for any injury to person (whether or not resulting in death) or damage to property arising out of any act of war, insurrection, revolt or other civil uprising, hijacking or military action occurring in the countries of origin, destination or passage.
In case of a medical problem arising during the trip/charter, either on board or on shore, which results in costs for evacuation, use of aircraft or repatriation, the responsibility for payment of these costs belongs solely to you. If Offshore Adventures incurs any costs in relation to the foregoing, these will be invoiced to you.

Loss or damage to personal belongings:
Offshore Adventures does not take any responsibility for loss or damage to guest’s personal belongings that are due to transportation, accidents, theft or any other means.

Medical and Health:
Offshore Adventures staff is not qualified to give you advice or assistance on medical matters. If any medication or advice is given by an Offshore Adventures staff member or owner, you accept that you accept responsibility for all risk taken in accepting such advice or medication. Offshore Adventures staff will not be responsible or liable for any issues caused by advice or medication given.

Laws
This agreement is deemed to be formed in New Zealand. Any dispute between Offshore Adventures and you shall be subject to, governed by and construed according to the laws of New Zealand.

Complaints
In the unlikely event of a problem the matter must be immediately brought to the attention of the responsible person and you should allow this person the opportunity to resolve the matter.
In the unlikely event of the problem not being resolved satisfactorily, full details with supporting documents/records should be filed as a formal complaint and sent to the Offshore Adventures office in writing no later than 14 days after the incident. The responsible person will be requested to provide Offshore Adventures Management with a full written report of the incident.
It is essential that clients follow procedure to enable the company’s managers the opportunity to personally investigate the problem. We regretfully will not accept any complaint as valid unless the correct reporting procedure is adhered to.
In the event that you are entitled to and receive a refund after your trip, an administration fee will be deducted from such refund, to cover our own costs.

Copyrights
Offshore Adventures reserves the right without further notice to make use of any photography or film taken on the trip by its staff for general publicity purposes without payment or your further permission.

By booking this charter you agree to the following terms and conditions.
